In addition you and SD Visions LLC employees communicate with each other via all standard forms of communication and as a part of its process SD Visions LLC stores information about every transaction that it processes for you. SD Visions LLC stores all information and communications it deems relevant to conducting its business, and that information becomes the property of SD Visions LLC at the time it is received or generated.

SD Visions LLC may share any information about you and your company when required by third parties in processing credit cards and online checks.

Merchants with subscription transactions only: SD Visions LLC will not otherwise disclose its merchants’ personal and account information unless SD Visions LLC has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of SD Visions LLC, SD Visions LLC’s merchants, or others, or where SD Visions LLC has a good faith belief that the law requires such disclosure.

Merchants with tangible goods: If you are processing transactions for tangible goods your contact information is readily available on your website. If SD Visions LLC receives a written request from a legitimate law enforcement agency that is investigating a fraudulent use of card complaint SD Visions LLC will, without consulting you, provide law enforcement your contact information. Otherwise, SD Visions LLC will not disclose its merchants’ personal and account information unless SD Visions LLC has reason to believe that disclosing such information is necessary to identify, make contact with, or bring legal action against someone who may be causing harm or interfering with the rights or property of SD Visions LLC, SD Visions LLC’s merchants, or others, or where SD Visions LLC has a good faith belief that the law requires such disclosure.

SD Visions LLC also will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that SD Visions LLC stores or transmits to or receives from its merchants. The circumstances under which SD Visions LLC will disclose such electronic merchant communications are when:

1. It is necessary in order to provide service to the Merchant,
2. It is necessary to protect the legitimate interests of SD Visions LLC and its merchants,
3. It is required to cooperate with interception orders, warrants, or other legal process that SD Visions LLC determines in its sole discretion to be valid and enforceable; and
4. It is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by SD Visions LLC and appear to pertain to the commission of a crime.

By using SD Visions LLC’s services, you agree that we may release information obtained in the course of your use of SD Visions LLC’s services when it is believed, in SD Visions LLC’s sole and absolute discretion, that the release is appropriate or otherwise necessary to comply with the law, enforce our Agreement, and/or protect the contract and other rights of SD Visions LLC and our merchants.

SD Visions LLC will, however, review, delete or block access to communications that may harm SD Visions LLC, its merchants or third parties. The grounds on which SD Visions LLC may take such action include, but are not limited to, actual or potential violations of SD Visions LLC’s Acceptable Use Policy (AUP). It is your obligation to provide SD Visions LLC with accurate and up-to-date information, and failure to provide us with such information could void any Agreement between you and SD Visions LLC. We use the information that you provide for such purposes as processing transactions, loss prevention, improving our service, communicating with you, and fulfilling our obligations to you. SD Visions LLC’s employees have access to your information on a need to know basis. SD Visions LLC will not sell your information to a third party for any reason.

To the best of its ability, SD Visions LLC employs the latest and best techniques available for protecting it systems from intrusion by unauthorized individuals, and is constantly upgrading its security as better methods become available.
